Customers sue OnlyFans—thought they were talking with a person, not a bot

As adult content creators rely more and more on artificial intelligence systems to match their fans’ equally rising demands, a recent class action lawsuit reveals a dark side to this arrangement: that there’s a big difference between using AI to help make their customers happy instead of flat out deceiving them.

As reported by Court Watch in collaboration with 404 Media, Illinois residents IM. Brunner and J. Fry are suing OnlyFans—the popular live-streaming platform—for an undisclosed amount.

The plaintiffs claim the performers they’d subscribed to couldn’t have been authentic. They became suspicious after “realizing that a single individual could not send the number of direct messages or videos that generating revenue from 700,000 fans, in one creators’ case, would require.”

Nothing up my sleeve

While the plaintiffs haven’t yet provided actual evidence that they were intentionally tricked into conversing with some form of AI, they described some relatively well-known chatbot tells, specifically “contradicting information and errors” in the messages they’d received.

The suit expressly claims OnlyFans duped Brunner and Fry, in the process violating the terms of their customer agreement, disappointing “the reasonable expectations of Plaintiffs and Class Members, thereby depriving them of the benefit of their bargain.”

As of this date, OnlyFans has not responded to 404 Media’s inquiries but referenced a 2024 Cosmopolitan article in which a spokesperson for the platform stated, “Creators may choose to work with a wide range of third parties, including photographers, videographers, talent managers and agencies, to curate and monetise their content.”

To put it even more succinctly, “Any third party that a creator elects to work with does not work on behalf of OnlyFans and is not affiliated with the company in any way.” 

Take a card, any card

In contrast to Brunner and Fry’s allegations of being duped, cam performer Chloe Amour, who licensed her physical likeness and on-screen persona to an AI company, was transparent about the arrangement.

She said it was to make her life easier as well as satisfy her fans, “Sometimes there are things that they want to talk about with me, or there are things that they want from me that I might not be able to give them.”

If Brunner and Fry’s suit does have merit, it could be yet another unfortunate sign that AI users and developers are woefully, or worse, willingly ignorant of how vitally important informed consent should and must be.  

A good example is the unauthorized use of everything from books to films in training Large Language Models, which has led to not one, not two, but nearly forty—and counting—separate lawsuits, as noted by The Copyright Alliance.

Though AI image generation software built from authorized media, such as Chloe Amour’s digitized self, may remain controversial, at least consumers can know what it is and where it came fromand decide whether or not to use it.

Should Brunner and Fry be proven correct, the case could become a crucial benchmark clearly establishing where human adult content creators end and their use of chatbots and their like begin.

In fact, it’s more than somewhat surprising we haven’t seen similar suits. This might be either because AI assistants are just that good, cam show fans don’t care, or don’t care enough to go to court over them—yet!

Watch me pull a rabbit 

If Brunner and Fry’s suit is found in their favor, if the live adult entertainment industry takes notice, if platforms like OnlyFans realize they have to step up, if everyone finally gets why informed consent isn’t just a nice idea but essential, then fingers crossed, we wouldn’t have to worry about being tricked.

Rather, we’d know from the get-go whether we’d be interacting with a person or a bot, and the same would be true for being informed right up front if anything is AI-generated or not.

Lawsuits may not be what gets us there, nor will raising our voices in protest, but what is certain is if we don’t do something, anything, and soon, duplicitous AI practices will become the norm—and consent tragically a thing of the past.

The often surprising ways adult entertainers have thrived post-pandemic

The year 2020 was a watershed moment for many industries, including adult entertainment. As the world grappled with isolation amid the coronavirus pandemic, audiences flocked to digital platforms for connection and escapism. Industry creators and consumers alike had to adapt to the new normal. However, as restrictions eased and society began to reopen, the challenge became maintaining the momentum generated during that unprecedented period.

An adult-friendly option

OnlyFans officially launched in 2016 but skyrocketed in popularity in 2020 due to the COVID-19 pandemic. Creators on the platform experienced huge growth as users grew due to OnlyFans being friendly to adult performers. Adult creator, Bea York has utilized multiple social media platforms to create a large following that caters to those looking to fulfill their fantasies. She first joined OnlyFans in 2019 after Patreon moved away from adult content.

“I joined in September of 2019. So it was just starting to become a thing, and people are just starting to talk about it, just as another option, because I think Patreon had made the move away from adult content. And that was just another option out of several other platforms, where it was adult-friendly. So it was just like of the list of options, it was one of the ones that my peers and I selected to try out. And then of course, like six months, a year later blew up,” York said.

York’s foray into adult content began with underwear sales on Reddit. The platform proved a solid springboard for her burgeoning career in adult creation.

“Reddit being an amazing resource for almost any topic was like an easy spot, especially if you wanted to be an anonymous seller, which means that you don’t like necessarily show face. And you’re very private with your identity. And so that was a great place to start to dip your toes into adult work,” York said.

Fighting suppression on social media platforms

According to a 2024 TechReport article, OnlyFans has an average of 170 million users but they often have to work hard to find their favorite creator as OnlyFans has a limited search function. This has made it imperative for users to promote their content on social media, but users who do not fit the preferred body type of social media platforms often face discrimination.

Ashley Elizabeth, who first started the content on YouTube in 2008, created various videos about advice, unboxing, and beauty videos before transitioning to Patreon and OnlyFans in 2020. Elizabeth’s main YouTube channel has amassed over 417,000 subscribers and has led her to have a strong social media following. However, she stated there’s a high learning curve for those who want to begin creating adult content. 

“It’s hard because you have to learn a whole new language, especially if you don’t have a social media following. You have to learn Reddit you have to learn Twitter, you have to learn all these terms of services, and then you can’t go against them. And you have to be sly enough to promote it here and then have these link click through websites. And it’s difficult for people to do when they’re starting from nothing,” Elizabeth said.

Not that things were always easy 

But just because creators have a fan following on social media platforms doesn’t mean they don’t encounter consistent challenges. Elizabeth explains how she often has to be mindful of what she posts to avoid suppression of her content. 

“I had an Instagram post be taken down when I was 30 pounds heavier in a bikini versus now because I would assume it’s because it’s not a socially acceptable body versus what you typically see. And then I’ve had TikTok accounts be banned for mentioning OnlyFans, and now you have full TikTok accounts, just talking about OnlyFans. So it really does seem kind of like what they latch on to take down. And now I’m very, very careful about the things that I post, and it’s very much if you’re interested, you kind of got a search through it,” Elizabeth said.

Bea York has encountered similar challenges and believes social media algorithms are biased toward non-traditional body types. 

“I think the biggest adjustment that I’ve done is to not put as much love and effort into something that will most likely be suppressed by the algorithm. I mean, not only because I’m in the adult industry, but the other biggest thing that I’ve seen is that the algorithm is incredibly biased towards curvier bodies, and larger bodies in general. So things that other people can get away with on Instagram or YouTube. I absolutely can’t,” York said.

Advice when entering the adult space in 2024

The secret is out as OnlyFans has exploded in popularity, attracting an estimated 1.5 million to 2 million content creators. Celebrities such as Cardi B and Bella Thorne have capitalized on the platform, demonstrating its potential as an additional revenue stream.

New creators face an uphill battle to gain traction but there is hope if creators can use their social media followings to lead them to OnlyFans page. 

“It helps to just kind of play around on TikTok and reels and Instagram and Twitter. Gain an audience that you can then bring over to your subscription sites,” York said.

While it’s important to build a social media following, Ashley Elizabeth wants new creators to make sure to always respect their boundaries when making content.

“I would say tip wise is just do what you’re comfortable with. You have to be prepared if you’re new to turn down a crazy amount of money to do stuff that you’re not at the point where you’re comfortable yet and you have to be okay with that. Because honestly, you just can’t go outside your comfort zone and you have to be able to be safe,” Elizabeth said. 

Both creators have remained successful after the OnlyFans boom in 2020 by having a consistent social media following on multiple platforms and being able to adapt to the always-changing landscape of content creation.

The psychological complexities and preferences in online adult webcam experiences

Users of Chaturbate, one of the world’s most popular adult cam platforms, were the subjects of a major study just published in The Journal of Sex Research.

The study, titled Is Sex Cam Use a Substitute for “Real Sex?” Attitudes and Experiences of Consumers Using Adult Cam Platforms, is the latest research to come from Xtine Milrod, PhD (independent researcher) and Martin Monto, PhD (University of Portland). Since 2012, they have published several studies of the attitudes and habits of people—mostly men—who pay for various forms of sex. 

In a recent PsyPost article, study author Xtine Milrod explained why they chose to study Chaturbate viewers, “Since our research is generally focused on people who purchase sexual experiences, it was a logical evolution to investigate those who buy and enjoy those experiences primarily on line and not just away from screen.”

Milrod added, “I am also interested in under-researched populations; even with studies of webcam activities, the main focus has been on the performers and not the users.” 

The research also points out that “the market size of adult and pornographic websites in the US grew over 14% annually” between 2017-2022 and that Chaturbate is the fifth ranked adult website in the US.

Over ninety questions 

In PsyPost, Milrod explained, “With online and offline worlds blending in everyday life on a global scale, commercial sex in general and the sociocultural construct of “sex work” in particular have now firmly expanded into the digital sphere.” 

Milrod and Monto designed a complex study of 93 questions about everything from respondent demographics to the kinds of activities respondents most enjoyed. 

After screening for and sifting out bots, the survey gathered responses from 10,570 human respondents over the age of 18. 94.2% of the respondents identified as male. 75.1% of all respondents identified as heterosexual. 40.3% of all respondents had no sexual partners in the twelve months prior to taking the survey.

Navigating the distinction: webcam interactions vs. real-life connections

According to the study findings: “The majority of users (72.2%) found watching cams less satisfying than in-person sex, indicating that while webcam platforms offer certain advantages, they do not fully replace the physical and emotional connection found in real-life sexual encounters. 

Only 19.1% of respondents considered webcam interactions as “real sex,” suggesting a clear distinction in the minds of most users between digital sexual experiences and physical, real-world interactions.”

However, Milrod and Monto make the point that “it may be more self-soothing or rewarding to engage with a sexually responsive performer who manifests some interpersonal interest, rather than watching pornographic videos that have been edited to hypersexualize an encounter with no direct connection to the viewer at all.” The researchers also cite research which documents “a steady decline in partnered sex” in the US, in the last twenty years, providing a context for understanding webcam popularity.

User preferences from mutual masturbation to remote-controlled toys

Respondents expressed a high preference for “attractive, sexually responsive performers who enjoy credible orgasms on camera.” 

Almost 80% of respondents preferred to watch mutual masturbation by performers. 72.1% wanted to see performers using sex toys. 53% wanted to use remote controlled sex toys. Two women together and fellatio were equally popular options (48.1%). Penile-vaginal sex ranked lower than all of the above.

Gay and lesbian respondents preferred manual masturbation, fellatio, and two men together (there were very few lesbian respondents in the study). 

Milrod and Motto’s study includes many other detailed findings that are certain to be valuable to future sex researchers as well as sex tech entrepreneurs such as Chaturbate.

Fantasy identities might become the norm, allowing people to be who they want to be, taking a negative activity like catfishing, where someone pretends to be someone they’re not in order to trick people and transform it into a positive: a way for people to be who they want to be in virtual reality or to help them explore new gender expressions, personas, or craft entirely new identities.

The show must—and will—go on

Worried you’re not as adept at fashion or makeup as many of today’s e-girl or boy superstars?  

Not to worry, as today’s AI visual generation systems like DALL-E 2 and Midjourney can take a simple prompt and turn it into a hyper-realistic imagehere’s no reason to think we might not eventually be able to do the same to our metaverse identities.  

As e-girls and boys have shown us, when it comes to putting on a public or personal performance, there’s no limit to what’s possible and how, as with anyone who doesn’t identify as CIS-gendered is likely well aware, the bravest act anyone can perform is saying this is me.
